1. Services Description
Xpress Auto Transport is a licensed auto transport broker that arranges vehicle shipping services through a network of FMCSA-registered motor carriers. We coordinate the pickup, transit, and delivery of vehicles but do not physically transport vehicles ourselves. The actual transportation is performed by independent motor carriers.
2. Quotes and Pricing
- Quotes are estimates based on current market conditions and information provided
- Quotes are valid for the timeframe specified (typically 7-14 days)
- Final pricing may vary based on actual carrier acceptance, vehicle condition at pickup, and route specifics
- We do not require upfront payment to provide a quote
- Final payment is typically collected upon delivery of your vehicle
3. Booking and Cancellation
Booking
Once you accept a quote and provide booking information, we begin sourcing a carrier for your shipment. Bookings are considered confirmed when a carrier is assigned to your shipment.
Cancellation
- Cancellations made before a carrier is assigned: No fee
- Cancellations after carrier assignment but before pickup: Possible cancellation fee (typically $0-$100 depending on circumstances)
- Cancellations on the scheduled pickup day or after vehicle is picked up: Subject to carrier fees and dry-run charges
4. Customer Responsibilities
By booking with us, you agree to:
- Provide accurate vehicle information (year, make, model, modifications, operating condition)
- Prepare your vehicle properly for transport (1/4 tank fuel, disabled alarms, removed personal items)
- Be available (or designate someone) at both pickup and delivery locations
- Inspect the vehicle and bill of lading at pickup and delivery
- Pay the agreed amount upon delivery
- Provide a clear, accessible location for pickup and delivery
- Notify us immediately of any damage discovered at delivery
5. Carrier Insurance and Liability
All carriers in our network maintain federally-required cargo insurance. Coverage levels typically include:
- Open carriers: $100,000+ per vehicle cargo coverage
- Enclosed carriers: $250,000-$500,000+ per vehicle cargo coverage
Any damage claims should be noted on the bill of lading at delivery and reported to us immediately. Damage not noted on the delivery bill of lading may not be eligible for claims.
6. Limitation of Liability
Xpress Auto Transport acts as a broker. We are not liable for:
- Damage caused during transit (the carrier and their insurance are responsible)
- Delays caused by weather, traffic, mechanical issues, or other factors outside our control
- Personal items left in the vehicle (these are not covered by carrier insurance)
- Indirect, consequential, incidental, or special damages
- Loss of use, lost profits, or other economic losses
Our maximum liability under any circumstance shall not exceed the amount you paid for our brokerage service.
7. Personal Items in Vehicles
Federal regulations and carrier policies generally prohibit personal items in shipped vehicles. Some carriers allow up to 100 lbs of items in the trunk, but:
- Personal items are not covered by carrier insurance
- You are responsible for any damage caused by items shifting during transit
- Hazardous materials, weapons, and ammunition are strictly prohibited
- Theft of personal items is not covered
We strongly recommend removing all personal items before pickup.
8. Pickup and Delivery Windows
Auto transport involves multiple vehicles on a single trailer with varying schedules. Therefore:
- Pickup windows are typically 1-3 days (or more during peak season)
- Delivery windows are typically 1-3 days from the estimated date
- Exact times cannot always be guaranteed
- Drivers communicate with you 24 hours before pickup and delivery
- Delays may occur due to weather, traffic, mechanical issues, or other operational factors
9. Disputes and Damage Claims
If damage occurs during transit:
- Note all damage on the bill of lading BEFORE signing at delivery
- Take photographs immediately
- Notify us within 24 hours
- We will assist in filing a claim with the carrier's insurance
- Carrier insurance claims are typically resolved within 30-60 days
10. Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved through:
- Good-faith negotiation between the parties
- Mediation, if negotiation fails
- Binding arbitration in accordance with the rules of the American Arbitration Association
You agree to waive any right to participate in a class action lawsuit against us.
11. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any legal action shall be brought in the courts of Florida.
12. Intellectual Property
All content on this website, including text, graphics, logos, images, and software, is the property of Xpress Auto Transport or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.
13. Website Use
You agree to use our website lawfully and not to:
- Access the site for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Use automated systems (bots, scrapers) to access the site without permission
- Submit false or misleading information
- Interfere with or disrupt the site's operation
14. Changes to Terms
